Business and Human Rights Law and Practice
Presented by the OBA Internationl Law Section
This CLE will provide background on the growing field of business and human rights and address statutory and regulatory compliance and risk in the US, EU, Canada, and elsewhere, with a focus on issues such as the legal and practical consequences of forced labor in the supply chain, freedom of expression online, and AI and human rights. This CLE will offer recommendations about how lawyers can address these issues to reduce such risks across jurisdictions.

Randy Bregman has focused his practice on the former Soviet Union region and Eastern Europe for forty years and has significant experience in corporate, policy, anti-corruption, sanctions and trade matters. He advises Western clients and clients in the region in a diverse range of industries, including banking and finance, oil, steel, pharmaceuticals, telecommunications and consumer goods. He has also supervised litigation and administrative disputes in the former Soviet Union.
Randy has advised US and European companies and NGOs on human rights and anti-corruption issues for more than fifteen years. He has designed due diligence checklists for companies in the area of human rights and training programs for financial institutions. He has spoken at webinars and law school events on developing trends in global modern slavery legislation and the Global Magnitsky Act.
Working closely with Human Rights First, Randy has reviewed and revised submissions for Global Magnitsky human rights abuse sanctions and, more recently, sanctions against military officers for abuses in Ukraine. He has also represented several pro bono clients in asylum and resettlement matters.
In 2021, Randy was the recipient of Human Rights First’s inaugural "Global Accountability Guardian Award," honoring champions of human rights who work relentlessly to hold accountable human rights abusers around the world.
Alexander Kurt Preve is a managing associate in Dentons’ Commercial Litigation practice, based in the San Francisco office. His practice focuses on complex civil litigation with an emphasis on high-stakes business disputes and insurance coverage. Alex has represented clients across a range of industries, including Bay Area technology start-ups, venture capital, gaming, telecommunications, and commercial real estate development.
Alex is also a member of Dentons’ Business and Human Rights team, where he advises companies on human rights due diligence, forced labor and supply chain risk, and remediation under the UN Guiding Principles on Business and Human Rights and related regimes such as the Uyghur Forced Labor Prevention Act, Section 307 of the Tariff Act, and the EU Corporate Sustainability Due Diligence Directive.
In addition to his commercial practice, Alex maintains a robust pro bono portfolio in international human rights law, international humanitarian law, and other areas of public international law. He has contributed to Global Magnitsky Act human rights abuse sanctions submissions and assisted Corporate Accountability Lab in securing a Withhold Release Order from U.S. Customs and Border Protection against a company implicated in forced labor practices. He also supports IILA, a nonprofit advisory group, in assisting small and developing countries with the development and application of customary international law.
Before joining Dentons, Alex clerked for the Honorable Edward M. Chen of the U.S. District Court for the Northern District of California. He earned his J.D. from Vanderbilt University Law School, where he served on the editorial board of the Vanderbilt Journal of Transnational Law. He received his B.A. in Foreign Affairs from the University of Virginia, graduating Phi Beta Kappa. Alex is fluent in Spanish.
Joshua Kretman is a counsel in Dentons' Regulatory, Public Policy and Government Affairs practice where he advises clients on critical national security and trade-related matters including economic sanctions, export controls, and related compliance and enforcement issues. He provides strategic, practical guidance to clients navigating challenging regulatory and statutory landscapes, particularly in the context of complex transactions, investigations, and risk mitigation efforts.
Joshua brings extensive legal and policy experience from senior roles at both the US Department of State and the US Senate and leverages his first-hand understanding of complex processes, dynamics, and decision-points in both the Executive Branch and the US Congress. He served as the Deputy Assistant Secretary (acting) for Counter Threat Finance and Sanctions in the Bureau of Economic and Business Affairs at the State Department, where he played a leading role in shaping and implementing US policy on economic sanctions and export controls. He led the Department’s sanctions policy implementation efforts and worked closely with senior officials at the National Security Council and federal agencies including the Departments of the Treasury, Commerce, and Justice.
Joshua also served as Senior Counsel at the US Senate Foreign Relations Committee between 2022 and 2024, where he drafted sanctions and export control legislation, as well as other priority legislation such as National Defense Authorization Act provisions related to defense trade controls and foreign military sales. Joshua was the Senate’s foremost expert on international law, shepherding successful efforts to secure Senate approval of tax treaties, other business-related treaties, and NATO accession protocols.
Previously, as an Attorney Adviser in the Office of the Legal Adviser at the Department of State for more than a decade, he served as the lead sanctions attorney and advised senior officials on legislation and appropriations, international human rights law, ethics, and international claims and investment disputes.
Prior to working at the Department of State, he clerked for the Honorable Janet Bond Arterton in the US District Court for the District of Connecticut. Mr. Kretman received his B.A. with distinction from Yale University and his J.D. from Stanford Law School.
